NEMAHA COUNTY BOARD OF COUNTY COMMISSIONERS
PUBLIC HEALTH ORDER
WHEREAS, on the 27th day of July, 2020, the Board of County Commissioners of Nemaha County, Kansas, considers Executive Order No. 20-59 issued by Kansas Governor Laura Kelly.
WHEREAS, the Board of County Commissioners finds that a disaster has occurred, or the threat of thereof is imminent within Nemaha County, Kansas, as a result of the Coronavirus pandemic (COVID-19) and the confirmed outbreak and person-to-person spread of COVID-19 in the United States of America, the State of Kansas, and Nemaha County.
WHEREAS, as a result of the Coronavirus pandemic, Kansas Governor Laura Kelly has issued Executive Order No. 20-59 which includes mitigation procedures schools must follow including orders mandating the wearing of face masks, social distancing, the use of hand sanitizer, and the taking of temperatures before entering buildings.
WHEREAS, the Board of County Commissioners have consulted with the Nemaha County Local Health Officer regarding Executive Order No. 20-59.
WHEREAS, the Nemaha County Local Health Officer strongly recommends that schools adopt and utilize, at a minimum, the guidelines set forth in the "Operations" section of "Navigating Change - Kansas' Guide to Learning and School Safety Operations."
WHEREAS, all eight physicians in Nemaha County also recommend that schools adopt and utilize, at a minimum, the guidelines set forth in the "Operations" section of "Navigating Change - Kansas' Guide to Learning and School Safety Operations."
WHEREAS, the Kansas State Board of Education unanimously voted to approve the guidelines set forth in "Navigating Change- Kansas' Guide to Learning and School Safety Operations."
WHEREAS, pursuant to K.S.A. 48-925(h), the Board of County Commissioners may issue an order relating to public health that includes provisions that are less stringent than the provisions of an executive order issued by the Governor.
WHEREAS, having consulted with the Nemaha County Local Health Officer, implementation of the full scope of the provisions in Executive Order No. 20-59 is not necessary to protect the public health and safety of students, teachers, and others in Nemaha County.
WHEREAS, it is necessary and appropriate to issue an order relating to public health that includes provisions that are less stringent than those included in Executive Order No. 20-59.
NOW, THEREFORE, BE IT ORDERED by the Board of County Commissioners of Nemaha County, Kansas, pursuant to K.S.A. 48-925(h), that:
1. It is ordered that all schools in Nemaha County adopt and utilize, at a minimum, the guidelines set forth in the "Operations" section of "Navigating Change - Kansas' Guide to Learning and School Safety Operations."
2. No school shall be required to abide the requirements set forth Governor Laura Kelly's Executive Order No. 20-59, which shall have no force and effect in Nemaha County.
